On the basis of the Salmon and Inland Fisheries Act, the association has been appointed to oversee the watercourse.
The scope of supervision is:
The anadromous part of the Kvalsund watercourse which the association leases for the Finnmarkseiendommen (FeFo).
The anadromous part of the Kvalsund watercourse which the association manages for Hammerfest municipality and private landowners.
The association's guards, the State Nature Inspectorate, FeFo's guard and the Police control the watercourse both during and outside the fishing season. The association's guards carry identification issued by the lessee.
Power of attorney:
The association's guards have extensive powers of control.
The guards are bound by a duty of confidentiality and have guidelines to follow. There are no requirements for courses or limited police authority to be the association's guard.Only guards appointed by the Kvalsund Sportfishing Association, the State Nature Inspectorate, FeFo's supervision and the Police have supervisory rights.
It is forbidden for anyone else to check on fishermen in the association's charter and administration area.
The association's guards:
Is required to check fishing licences, fishing fees, identification, disinfection, catch, fishing equipment in use, and that fishing takes place in accordance with the association's regulations.
Can carry out so-called temporary sanctions in the field, i.a. expel people to stop ongoing breaches of the association's regulations, and/or breaches of public regulations.
Must immediately report to the association's board both minor and major rule violations that are discovered.
Can, if necessary, require the help of the police to carry out the check. (based on section 42 of the Salmon and Inland Fisheries Act)
Can use sound, video/images as documentation measures.
The board determines the final form of sanction:
As mentioned above, the association's guards can impose temporary sanctions in the field, but it is the association's board that adopts the final form of sanction against rule breakers.
A written decision from the board will always be sent to the violator in the event of a rule violation, and this may be different (stricter/lenient) in relation to what the guard in the field has communicated to the violator.
Fisherman's duty when checking from a guard:
Fishers have a duty to cooperate, and a duty to cooperate under the control of the association's guards, the Norwegian Nature Inspectorate the FeFos guard and the police. When checked by the above, fishermen must present valid documentation, catch, fishing equipment in use on request, and comply with any orders.
Guard with limited police authority:
Guards with limited police authority are also authorized to carry out checks on public and privately owned land in accordance with the Salmon and Inland Fisheries Act. Limited police authority may also be granted for several environmental laws.
